Privacy notice concerning the Bucherer recruitment platform


In this privacy notice we will inform you about how we process your personal data in relation to your application and about your rights.
 
  1. Controllers and contact addresses The controller responsible for processing your personal data for each job advertisement is the corresponding Bucherer group company (hereinafter referred to as ‘Bucherer Company’):

    Some data is processed by companies in the Bucherer Group acting as joint controllers. These currently include the Bucherer group companies listed above with Bucherer AG with registered office in Switzerland as the parent company.

    You can contact the data protection contact person or, if appointed, the data protection officer (currently for Bucherer Deutschland GmbH) via email at data-privacy@bucherer.com or by post by writing to the relevant address indicated above including the words ‘Data Privacy’ and indicating the specific Bucherer Company responsible in your case for processing data.
 
  1. What kind of information do we ask you for? What kind of data concerning you is processed by us?
    In order to examine your application, we require some personal information from you. This information is no different from the information usually collected during an application process. So during the application process, apart from your title, name and surname, the usual correspondence details such as postal address, email address and telephone numbers are also stored in the electronic recruiting system. Finally, you have the option of indicating you date of birth and your nationality. As your potential future employer, we are naturally also interested in your language skills. Application documents such as motivation letters, your curriculum vitae, professional, educational and training qualifications and job references are also collected. It goes without saying that any additional information contained in such documents is treated by us with the same degree of confidentiality as the information directly inputted by you into the system. Please make sure that you do not provide us with any information or file attachments containing especially sensitive personal data, in particular information regarding your ethnic background, political, religious or philosophical beliefs, membership of trade unions, health and sexual orientation
    All the information disclosed by you when applying for a job is provided voluntarily and enables us to examine your application.
 
  1. What kind of data is processed when using the electronic recruiting system?
    When you access the electronic recruiting system the server you use can be identified by means of the internet protocol address. For data security reasons, we store such internet protocol addresses (IP addresses) in logfiles. Under no circumstances is the information contained in logfiles used to identify users; they are merely used to defend against unlawful or criminal server attacks directed at your data or the functioning of the database. We also use IP addresses to compile general and anonymised statistics, e.g. on visitor numbers, page impressions and so on. However, this information is not used to create traceable user profiles.
 
  1. For what purposes is your information used?
    You want to reply to a job ad for a Bucherer Company? The information and documents submitted by you on the Bucherer recruitment platform are primarily processed and stored by the Bucherer Company that placed the job advertisement. The purpose of the processing is to check your application with regard to the job offered.
    The data is solely processed in relation to your application.
 
  1. What is the statutory/legal basis for processing your personal data? We process personal data in line with the applicable privacy laws (e.g. the Federal Act on Data Protection Act (FADP) or the GDPR) and other relevant laws.
    The legal basis for the processing of data is the initiation of contract negotiations or the management of contractual relationships. If you provide your explicit consent for the processing of your personal data for specific purposes, this processing is deemed lawful based on the consent provided by you (e.g. consent for the storage of your applicant details    for the applicant pool described in no. 8 below). Any consent given can be revoked at any time with effect for the future. Further, we may process your personal data if this is required in order to fulfil legal obligations or to defend against any legal claims asserted against us.
 
  1. How and where is your data stored? How long is it stored and when is it deleted?
    Your data is stored on behalf of the corresponding Bucherer Company on a server run by the operator of the Bucherer Group recruitment platform, umantis-HAUFE AG. The server is located in Germany. Your data is protected at all times using appropriate organisational and technical means against accidental or deliberate manipulation, loss, destruction or access by unauthorised persons. Data is transmitted in an encrypted format to prevent misuse by third parties. All the security measures are adapted on an ongoing basis to incorporate the most recent technological developments. Please note that SSL encryption for data transmitted over the internet is only active if the key symbol appears in the lower menu bar of your browser window and the address begins with https://www----. We use this encryption method when transmitting your data.
    Your data is stored for as long as the application for the advertised post in question is ongoing or when it becomes clear that a vacancy will not be taken up.
    If you successfully conclude the application process, your information and data is retrieved from the system and transferred to your personnel file and stored there.
    All the information and documents relating to unsuccessful candidates for a job are erased four (4) months after the application process has concluded at the very latest. No announcement is issued regarding the erasure of data.
    If you are interested in other job offers within the Bucherer Group you can authorise us to store and process your data beyond the period corresponding to a specific application process. This enables us to consider your application to see whether it meets the requirements of another position (see consent for storage of your applicant details in no. 8 below).
    Naturally you can erase the information and documents disclosed by you from our database at any time by visiting the Bucherer recruitment platform.
 
  1. Who has access to your information and/or who will process this information?
    Your data and documents can only be accessed by employees at the personnel services division and by the persons at the Bucherer Company in question with specific responsibility for such matters. Internal and external service providers may be engaged by the Bucherer Company in connection with the use of the recruitment platform and evaluation of applications. However, they only process your data on behalf of the Bucherer Company in respect of which you have submitted your application, for the aforementioned purposes. Moreover, they are bound to maintain confidentiality by law and contractually.
 
  1. Consent for storage of my applicant details for applicant pool and disclosure to other Bucherer Companies
    If you have provided your consent when inputting your information by clicking on the checkbox, you agree to the storage of the data supplied during your application irrespective of any specific application process in an applicant pool for a period of six (6) months and to its transfer to Bucherer Companies interested in your profile.
    You will be notified via email about the imminent erasure of your data. The email contains a confirmation link which you can use to prevent the erasure of your data from the applicant pool and trigger a further period for the inclusion of your data in the applicant pool.

    You can revoke the consent given on any occasion for the continued use of your personal data at any time with effect for the future. Please contact the relevant Bucherer Company if you wish to revoke your consent (see contact details in no. 1).
 
  1. Right of objection You have the right to object to the processing of your personal data for reasons relating to your particular circumstances at any time if we process your data when exercising a legitimate interest or for tasks in the public interest. In the event of the legitimate exercise of your right of objection, we are obliged to cease any further processing of your data forthwith, unless the processing is required for overriding, compelling or legitimate reasons or to establish, exercise or defend legal claims. The right of objection may be subject to limitations as set out in the applicable data protection laws. 
 
  1. Your other rights Right to information: You have the right to obtain information at any time about the personal data concerning you processed by us. The information is provided subject to the rights and freedoms of other persons who could be adversely affected by the data disclosed. In addition, any limitations on your right to information under prevailing data protection laws must be taken into account.
    Right to rectification: You have the right to obtain without undue delay the rectification of inaccurate personal data stored by us or to have incomplete data completed. 
    Right to erasure: Generally speaking, you also have the right to request the erasure of personal data stored by us, provided the processing is not required to exercise the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest or to establish, exercise or defend legal claims. The limitations on the right to erasure under prevailing data protection laws must be taken into account.
    Right to restriction of processing: You have the right to obtain the restriction of the processing of your personal data. This applies, in particular, if you contest the accuracy of the data concerning you stored by us or if you have lodged an objection against processing. In such cases, we will restrict the processing of your data until we have addressed your concerns.
    Right to data portability: You have the right to receive the data provided to us concerning you in a structured, commonly used and machine-readable format or, provided this is technically feasible, to request its immediate transfer to another data controller. This right to data portability only applies if the processing is based on your consent or on a contract and is carried out using automated means. Any limitations under prevailing data protection laws must be taken into account.   
    Right of revocation: If we process data based on the consent provided by you, you also have the right to withdraw your consent at any time. The effect of withdrawing your consent will be that in the future, we will no longer process your data based on the consent previously given.

  1. Right to lodge a complaint If you consider that the processing of your personal data by us violates privacy provisions, you have the right to lodge a complaint before a supervisory authority, in particular, one based in the member state of your usual place of residence, your place of work or the place where the alleged violation occurred.   1. Who can you contact if you have problems with the online application process or questions concerning data processing in relation to your application? If you have any questions concerning the processing of your personal data by us and your associated rights or any other hints or suggestions, you can contact the relevant data protection contact person or data protection officer (contact details in no. 1).
